AZB & Partners represented Reliance General Insurance Company Limited
AZB & Partners successfully represented Reliance General Insurance Company Limited (“RGIL”) and defeated a summary judgment application under Order XIII-A of the Code of Civil Procedure, 1908, filed by Future Generali India Insurance Company Limited (“FGIL”) before the Bombay High Court (“Court”). The commercial suit was filed by FGIL seeking payment under a coinsurance contract for a crop insurance scheme in Rajasthan. The Court inter alia held that the very high threshold for a summary judgment is absent in this case since, in essence, the Court has to be satisfied that the defendant has no case, or he has zero credible defence and he does not deserve even a chance to lead oral evidence.
