Class Action Filed in Argentina Over Risks of AI-Enabled Facial and Voice Cloning

The Administrative and Consumer Relations Court of the Autonomous City has registered a class action initiated by the prosecutor of the Specialized Unit for Complex Litigation of the Public Prosecutor's Office to request that the executive branch block websites that use artificial intelligence to clone people's faces and voices.

In its filing, the Public Prosecutor's Office states that it has conducted specific tests to verify the operation of AI platforms available online and has found serious deficiencies that affect the obligation of service providers to ensure the information, security, and dignified treatment of consumers, as well as the rights to identity, privacy, and intimacy of individuals in general (cf. Articles 19 and 75, Section 22 of the National Constitution, Articles 12 and 39 of the CCABA and CCyCN), compliance with the provisions of personal data protection laws, and the guarantee of public safety.

It was emphasized how easily anyone can manipulate these AI platforms, to the point that even a high school student can do so. This also demonstrates how identity theft or the illicit use of others' biometric data can easily occur, particularly affecting children and adolescents residing in the City of Buenos Aires. Moreover, the case highlights the broader societal implications of AI in everyday life. As technology continues to evolve, it is crucial for policymakers to engage in proactive discussions about ethical standards, privacy protections, and the impact of AI on human rights.
