National Congress Has Approved a Bill for the Control and Regulation of Energy Drinks in Honduras

Our lawyer in Honduras, experts in Regulatory Law, shares this article on how the National Congress approved the Law for the Control and Regulation of Energy Drinks, which will regulate the sale of these beverages to protect the lives and health of minors in Honduras.

The National Congress approved the prohibition on the sale of energy drinks to people under 18. This was passed on April 25 of this year with the aim of safeguarding the lives and health of minors in Honduras.

The law will regulate the commercialization of all the drinks containing a combination of ingredients such as caffeine, sugar, taurine, carnitine, creatine, among others that may cause physiological effects such as increased heart rate, deeper breathing, and increased blood circulation to supply oxygen are prohibited.

The law also specifies the commercial establishments where the marketing of energy drinks is prohibited, including health facilities, academic institutions, as well as public and private sports facilities.

This bill was discussed with officials from the Health Regulation Agency (ARSA), who emphasized the consequences of selling energy drinks to minors without regulation. Therefore, the law empowers the health authority, who will be responsible for labeling standards for energy drinks, guaranteeing the identification of health risks, and empowering it to impose sanctions on those who contravene these provisions.

The Law for the Control and Regulation of Energy Drinks will come into force from the day of its publication in the Official Gazette La Gaceta.
